Power of Attorney

A Power of Attorney is a legal document whereby you appoint another person, called an “Attorney”, to make financial and legal decisions on your behalf. The Power can be specific or general. Note, a Power of Attorney will automatically end should you become mentally incompetent unless it is an “enduring” Power of Attorney.

There are specific rules for Powers of Attorney that deal with real estate. The Land Title Act sets out strict guidelines related to the form of the Power of Attorney, execution procedures and restrictions as to use. Note that some lenders will not allow mortgages to be signed by a Power of Attorney.
